Welcome to IGNI Processing. These Terms of Service ("Terms") govern your use of our booking and payment platform. By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using IGNI Processing ("Platform," "Service," "we," "us," or "our"), you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations.
If you do not agree with these Terms, you must not use our services.
2. Eligibility
You must meet the following requirements to use our Platform:
- Be at least 18 years old
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using our services under applicable laws
- Operate a legitimate business or service
- Provide accurate and complete information during registration
3. Service Description
IGNI Processing provides:
- Business Profiles: Tools to create and manage your business presence
- Booking System: Online appointment scheduling for your customers
- Payment Processing: Secure payment collection via Stripe Connect
- Calendar Integration: Optional Google Calendar synchronization
- Customization: Branding and styling options for your booking page
4. Account Registration and Security
4.1 Account Creation
To use our Platform, you must:
- Create an account with accurate information
- Verify your email address
- Complete your business profile
- Connect a Stripe account for payment processing
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of unauthorized access
- Using strong passwords and secure authentication methods
4.3 Account Suspension
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- You provide false or misleading information
- Your account poses a security risk
- You fail to pay required fees
5. Business Owner Responsibilities
As a business owner using our Platform, you agree to:
- Provide accurate information about your services, pricing, and availability
- Honor all bookings made through the Platform
- Provide services in a professional and timely manner
- Comply with all applicable laws and regulations
- Obtain necessary licenses and permits for your business
- Not engage in discriminatory practices
- Maintain appropriate insurance coverage
- Handle customer data responsibly and in compliance with privacy laws
6. Pricing and Payments
6.1 Platform Fees
IGNI Processing charges a flat platform fee of $2.50 per completed booking. This fee is automatically deducted from the payment before transferring funds to your connected Stripe account.
6.2 Stripe Fees
In addition to our platform fee, Stripe charges standard payment processing fees (typically 2.9% + $0.30 per transaction). These fees are separate from our platform fee.
6.3 Price Changes
We reserve the right to change our pricing with 30 days' notice. Continued use of the Platform after price changes constitutes acceptance of the new pricing.
6.4 Refunds and Chargebacks
- You are responsible for handling customer refunds through your Stripe dashboard
- Excessive chargebacks may result in account suspension
- Platform fees are non-refundable
- You are responsible for any chargeback fees imposed by Stripe
7. Payment Processing
7.1 Stripe Connect
Payment processing is handled by Stripe. By using our Platform, you agree to:
- Stripe's Terms of Service
- Complete Stripe's verification process
- Provide accurate banking information
- Comply with payment card industry (PCI) standards
7.2 Fund Transfers
Customer payments are processed through Stripe and transferred to your connected account after deducting:
- Our $2.50 platform fee
- Stripe's processing fees
- Any applicable refunds or chargebacks
7.3 Payment Disputes
You are responsible for resolving payment disputes with your customers. We are not a party to transactions between you and your customers.
8. Intellectual Property
8.1 Our Rights
IGNI Processing retains all rights to:
- The Platform and its design, code, and functionality
- IGNI Processing trademarks, logos, and branding
- Documentation, guides, and support materials
8.2 Your Content
You retain ownership of content you upload (logos, descriptions, images). By using our Platform, you grant us a license to:
- Display your content on your booking page
- Store and process your content as necessary to provide services
- Use anonymized data for analytics and improvement
8.3 Prohibited Uses
You may not:
- Copy, modify, or reverse-engineer our Platform
- Remove or obscure our branding (unless "Hide Powered By" is purchased)
- Use our Platform to create a competing service
- Sell, rent, or sublicense access to our Platform
9. Data and Privacy
Our collection and use of personal information is governed by our Privacy Policy.
You are responsible for:
- Complying with data protection laws (GDPR, CCPA, etc.)
- Obtaining necessary consents from customers
- Securely handling customer data
- Promptly notifying customers of data breaches
10. Third-Party Services
Our Platform integrates with third-party services:
- Auth0: User authentication
- Stripe: Payment processing
- Google Calendar: Calendar synchronization (optional)
- SendGrid: Email notifications
- Twilio: SMS notification delivery
Use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions or policies of third-party services.
11. SMS Notifications
11.1 SMS Service
IGNI Processing offers optional SMS notifications for booking confirmations, appointment reminders, and cancellations. By opting in to SMS notifications, you agree to receive text messages at the phone number you provide.
11.2 SMS Consent
SMS notifications are only sent with your explicit opt-in consent. You can opt in during:
- Business onboarding (for business owners)
- Booking creation (for customers)
- Account settings (to enable/disable SMS)
11.3 SMS Message Types
You may receive the following types of SMS messages:
- Booking Confirmations: Sent immediately after a booking is created or payment is confirmed
- Appointment Reminders: Sent 24 hours before your scheduled appointment
- Cancellation Notifications: Sent when a booking is cancelled
11.4 SMS Opt-Out
You can opt out of SMS notifications at any time by:
- Replying "STOP" to any SMS message
- Replying "UNSUBSCRIBE" or "CANCEL" to any SMS message
- Disabling SMS notifications in your account settings
- Contacting us at support@igniprocessing.com
After opting out, you will receive a confirmation message. Opt-out requests are processed immediately.
11.5 SMS Costs
Message and data rates may apply. Standard carrier messaging charges apply. IGNI Processing does not charge you for SMS notifications, but your mobile carrier may charge standard messaging rates based on your mobile plan.
11.6 SMS Availability
SMS notifications are only available for mobile phone numbers. SMS cannot be sent to landline numbers. We are not responsible for SMS delivery failures due to:
- Invalid or inactive phone numbers
- Carrier network issues
- Phone number changes
- Carrier spam filtering
11.7 SMS Compliance
Our SMS notifications comply with the Telephone Consumer Protection Act (TCPA) and other applicable telecommunications laws. By opting in, you consent to receive automated text messages at the phone number you provide.
11.8 SMS Support
For help with SMS notifications, reply "HELP" to any message or contact us at support@igniprocessing.com.
12. Prohibited Activities
You agree not to:
- Use the Platform for illegal purposes
- Engage in fraudulent activities or money laundering
- Violate any laws or regulations
- Infringe on intellectual property rights
- Upload malicious code or viruses
- Attempt to gain unauthorized access to our systems
- Harass, abuse, or harm others
- Spam or send unsolicited communications
- Impersonate others or provide false information
- Scrape or collect data from our Platform
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy or reliability of information
We do not guarantee that the Platform will meet your requirements or that it will be available at all times.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the fees you paid in the 12 months preceding the claim
- We are not responsible for lost profits, revenue, data, or business opportunities
- We are not liable for actions or omissions of third-party services
15. Indemnification
You agree to indemnify, defend, and hold harmless IGNI Processing, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any law or regulation
- Your infringement of third-party rights
- Services you provide to customers
- Disputes with your customers
15. Term and Termination
15.1 Term
These Terms remain in effect while you use our Platform.
16.2 Termination by You
You may terminate your account at any time by contacting support@igniprocessing.com or through your dashboard settings.
16.3 Termination by Us
We may suspend or terminate your account:
- For violation of these Terms
- For illegal or fraudulent activity
- If your account poses a security risk
- With 30 days' notice for any reason
15.4 Effect of Termination
Upon termination:
- Your booking page will be deactivated
- You lose access to your dashboard
- Pending payouts will be processed according to Stripe's schedule
- You may request a copy of your data
- Certain provisions (indemnification, liability) survive termination
17. Dispute Resolution
17.1 Informal Resolution
Before filing a claim, you agree to contact us at support@igniprocessing.com to attempt to resolve the dispute informally.
16.2 Arbitration
Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, rather than in court, except for claims that may be brought in small claims court.
17.3 Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive your right to participate in class actions or class arbitrations.
18. Governing Law
These Terms are governed by the laws of the United States and the state in which IGNI Processing is registered, without regard to conflict of law principles.
19. Changes to Terms
We may update these Terms at any time. We will notify you of material changes by:
- Posting updated Terms on this page
- Updating the "Last Updated" date
- Sending email notification
Your continued use after changes constitutes acceptance of the updated Terms.
19. Miscellaneous
19.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and IGNI Processing.
20.2 Severability
If any provision is found unenforceable, the remaining provisions remain in full effect.
19.3 Waiver
Our failure to enforce any provision does not constitute a waiver of that provision.
20.4 Assignment
You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
19.5 Force Majeure
We are not liable for failures due to circumstances beyond our reasonable control.
By using IGNI Processing, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
